Minnesota AI and Utilization Review Bill advances in Senate Policy Committee

Legislation introduced to address the use of AI when conducting utilization reviews was passed by the Senate Judiciary and referred to Senate Commerce and Consumer Protection Committee. Overall, the bill would ban the use of AI tools in all utilization and prior authorization reviews performed by health plans or their vendors. To date, the bill’s author has not been willing to consider amendments from the industry.

Separately, the Senate Commerce Chair has said he intended to offer amendments supported by stakeholders to limit the scope of the bill to not using AI alone for adverse determinations and to remove the private right of action provision.

The Committee’s hearing and the Chair’s amendments will be an important procedural moment for the bill as it moves through the legislative process, particularly given ongoing discussions around guardrails, oversight, and human involvement in utilization review decisions.
