HHS and CMS Extend Marketplace SEP for Individuals Losing Medicaid

On March 28, CMS issued guidance on the Temporary Special Enrollment Period (SEP) for Consumers losing Medicaid or Children’s Health Insurance Program (CHIP) coverage due to unwinding of the Medicaid Continuous Enrollment Condition Operations for plan year 2024. CMS announced the Unwinding SEP end date will be extended to Nov. 30.

Under the updated guidance, Marketplace-eligible consumers who are disenrolled from Medicaid, CHIP, or a Basic Health Program have 60 days from the date on which they submit a new or updated application up until Nov. 30 to make a plan selection under the Unwinding SEP. Plan selections made under the Unwinding SEP by Nov. 30 will have coverage effective on the first day of the following month after plan selection. Plan selections made from Dec. 1 through Jan. 15 will follow normal open enrollment effective dates. This guidance is applicable to all Marketplaces.
