DOL issues electronic disclosure proposed rule

On July 22, the Department of Labor (DOL) issued a proposed rule on electronic disclosure by ERISA group health plans. The proposed rule would establish a safe harbor to permit ERISA group health plans to provide required documents electronically, similar to the 2020 safe harbor rule for pension plans. Cigna has been advocating for these proposals for several years through ERIC (the ERISA Industry Committee) and AHIP.

The DOL estimates that group health plans will save $3.9B over 10 years from reduced printing and mailing costs associated with paper disclosures, while giving participants and beneficiaries easier, more reliable, and more secure access to their health plan information. Cigna is reviewing the proposed rule with impacted business units to develop a comment strategy by the Sept. 21 deadline.
