Express Scripts Responds to House Oversight Committee Request for Testimony Clarification

Recently, the Chairman of the House Committee on Oversight sent letters to Adam Kautzner, President of Evernorth Care Services and Express Scripts, as well as executives from CVS Caremark and OptumRx, requesting whether they would like to clarify statements made during the Committee hearing on July 23, 2024.

In our response, we explain in substantive detail that each of Dr. Kautzner’s statements accurately and truthfully reflected Express Scripts’ business model and practice, as demonstrated in his oral and written testimony before the Committee, in Express Scripts’ prior submissions to the Committee and to the FTC.

The letter notes, “We acknowledge the Committee and the FTC may have their own views of the PBM industry. But disagreements do not constitute dishonesty… [Dr. Kautzner’s] statements were truthful, candid, and delivered in good faith and in ongoing cooperation with the Committee’s oversight efforts, as Express Scripts has done for the past 18 months.”

Based on a Sept. 12 Health Care Dive article, CVS Caremark and OptumRx similarly declined to make any corrections. The Committee’s next steps are yet unknown. In statements to the press, the Committee said it was reviewing the responses and subsequent documents provided.
