Pennsylvania Governor Approves PBM Restriction Legislation

Pennsylvania Gov. Josh Shapiro (D) signed HB 1993 into law. This bill was considered by the legislature in tandem with SB 1000. SGA opposed both pieces of legislation and worked closely with trade associations and the PA Chamber of Commerce to lobby key legislators on the worst aspects of the legislation. Our industry partners activated advocacy campaigns and SGA launched a client engagement effort in early June. 

Due to industry and business engagement, the legislation was favorably amended by removing a spread prohibition, a NADAC + $10.49 dispensing fee reimbursement mandate, prohibitions on exclusive specialty and mail order, and maximum PBM claims processing requirements and administrative fees restrictions. Nonetheless, Gov. Shapiro was supportive of the bill, which had significant bipartisan support within the legislature.
